1. These Terms
1.1 What these terms cover. This page, together with our Privacy Policy, Terms of Use and Acceptable Use Policy, tells you information about us and the legal terms and conditions on which we supply products to you from our website at www.gustharts.com.
1.2 Why you should read them. These terms will apply to any contract between us for the supply of products to you. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms please contact us to discuss. Before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order products from our site.
1.3 You should print a copy of these terms or save them to your computer for future reference.
1.4 These terms, and any contract between us, are only in the English language.
1.5 We do not give business customers all the same rights as consumers. Business customers have different rights where there is a problem with a product and we do not compensate them in the same way for losses caused by us or our products. You are a business customer if you are buying products wholly or mainly for use in connection with your trade, business, craft or profession.

Our registered office is at Milkhope Light Industrial Estate, Blagdon, Seaton Burn, Newcastle upon Tyne NE13 6DA. Our registered VAT number is 436 1126 78.

2.4 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
2.5 Writing includes emails. When we use the words writing or written in these terms, this includes emails.
3. Our Contract With You
3.1 Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend errors before submitting your order.
3.2 We also accept orders by telephone. If you would like to order products by telephone please call 01670 789701.
3.3 How we will accept your order. After you place an order, you will receive an email acknowledging that we have received your order. This does not mean your order has been accepted. Acceptance takes place when we email you confirming the products have been dispatched.
3.4 If we cannot accept your order. If we are unable to accept your order, we will inform you in writing and will not charge you for the product. If you have already paid, we will refund you the full amount, including delivery costs charged, as soon as possible.
3.5 Your order number. We will assign an order number to your order and tell you what it is when we accept your order.
3.6 Where we sell our products. We deliver products to addresses in the UK and to countries listed on our delivery page. Some products have restrictions for certain international delivery destinations. International orders may be subject to import duties and taxes, which are your responsibility.
3.7 If you are a consumer, you may only purchase products from our site if you are at least 18 years old.
3.8 Certain products can only be purchased if you satisfy the relevant legal age or other legal, regulatory or licensing requirements.
3.9 to 3.12 Business customers. If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use our site to purchase products. These Terms, our Privacy Policy, Terms of Use and Acceptable Use Policy constitute the entire agreement between you and us.
4. Our Products
4.1 Products may vary slightly from their pictures. Product images are for illustrative purposes only. Colours, sizes, weights, capacities, dimensions and measurements shown on our website are approximate only.
4.2 Product packaging may vary. Product packaging may vary from that shown on images on our website.
4.3 Measurements. If we are making a product to measurements you have given us, you are responsible for ensuring those measurements are correct.
5. Your Rights to Make Changes
If you wish to make a change to the product you have ordered please contact us. We will let you know if the change is possible and advise you of any changes to price, timing or anything else necessary as a result of the requested change.
6. Our Rights to Make Changes
6.1 to 6.5 We may amend these terms from time to time. The terms in force at the time of your order will apply. We may make minor changes to reflect laws, regulatory requirements or technical improvements. If more significant changes apply to your order, we will notify you and you may contact us to end the contract before the changes take effect.
7. Providing the Products
7.1 Delivery costs. Delivery costs will be displayed on our website. We may change the courier chosen for delivery depending on availability and location.
7.2 Delivery timing. We or our courier will deliver the goods as soon as reasonably possible and, for consumers, within 30 days after accepting your order unless we agree or provide another estimated delivery date.
7.3 Delays outside our control. We are not responsible for delays caused by events outside our reasonable control, including severe weather, strikes, transport disruption, public emergencies or other events beyond our control.
7.4 Collection by you. If you have asked to collect products from our premises, you can collect them during our normal working hours on weekdays, excluding public holidays.
7.5 to 7.6 Failed delivery. If no one is available to take delivery, we or our courier will tell you how to rearrange delivery or collect from a local depot. Additional storage or delivery costs may apply if delivery is not rearranged.
7.7 to 7.9 Late delivery rights. Consumers have legal rights if products are delivered late. Depending on the circumstances, you may be able to end the contract and receive a refund.
7.10 to 7.15 Responsibility, ownership and suspension. The product becomes your responsibility when delivered to your address or collected by you or your carrier. You own goods once payment has been received in full. We may suspend supply for technical, legal, regulatory or non-payment reasons.
7.16 Lost parcels. If your parcel is lost by the courier, please contact us within the timeframes specified in our delivery information. Once the courier classifies a parcel as lost, we can process a replacement order or refund. We will not be liable for consequential loss caused by delayed or lost parcels.
8. Your Rights to End the Contract
This clause only applies if you are a consumer.
You can always end your contract with us. Your rights depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract.
For most products bought online, you have a legal right to change your mind within 14 days and receive a refund under the Consumer Contracts Regulations 2013.
You do not have the right to change your mind for certain products, including personalised products, products liable to deteriorate rapidly, hygiene-sealed products once unsealed, sealed audio or software once unsealed, or products mixed inseparably with other items after delivery.
9. How to End the Contract With Us
To end the contract, call customer services on 01670 789701 or email sales@gustharts.com. Please provide your name, home address, order details and, where available, your phone number and email address.
If products have been dispatched or received, you must return them to us. If exercising your right to change your mind, you must send off the goods within 14 days of telling us you wish to end the contract.
We will pay return costs if products are faulty or misdescribed, or if you are ending the contract because of something we have done wrong. In all other circumstances you must pay return costs.
Refunds will be made as soon as possible and usually within 14 days from the day we receive the product back, or earlier if you provide evidence you have sent it back.
10. Our Rights to End the Contract
We may end the contract by writing to you if you do not make payment when due, do not provide necessary information, do not allow us to deliver products, or do not allow access needed to supply services.
If we end the contract in these situations, we will refund money paid in advance for products not provided, but may deduct or charge reasonable compensation for costs incurred as a result of your breaking the contract.
We may withdraw products and will endeavour to let you know at least 14 days in advance where possible.
11. If There Is a Problem With the Product

Consumers have legal rights under the Consumer Rights Act 2015. Goods must be as described, fit for purpose and of satisfactory quality.
Business customer warranty rights differ. Business customers must notify us in writing within 5 business days of delivery if a product does not comply with the business customer warranty.
International Warranty Claim Shipping Costs. For international customers, if a warranty claim requires the item to be returned to the manufacturer, all associated shipping costs, including postage, customs duties and handling fees, will be borne by the customer.
12. Price and Payment
The price of the product, including VAT where applicable, will be the price indicated on the order pages when you placed your order. Delivery charges are advised during checkout before you confirm your order.
Our site enables you to toggle between VAT inclusive and VAT exclusive figures. The price you pay is the VAT inclusive amount where applicable.
We accept payment with debit card, credit card, PayPal, Pay4Later and Amazon Pay. You must pay for products before we dispatch them.
If payment is late, we may charge interest at 4% per year above the Bank of England base lending rate.
13. Our Responsibility for Loss or Damage
This clause only applies if you are a consumer.
We are responsible for losses you suffer caused by us breaking this contract unless the loss is unexpected, caused by a delaying event outside our control, avoidable, or a business loss.
14. Business Customer Terms
This clause only applies if you are a business.
We only supply products for internal use by your business, and you agree not to use the product for resale purposes.
Subject to exclusions that cannot legally be limited, we will not be liable for loss of profits, sales, business, revenue, data, business opportunity, anticipated savings, goodwill, or indirect or consequential loss.
Our total liability to you for losses arising under or in connection with the contract shall not exceed the price of the products.
15. How We May Use Your Personal Information
How we use any personal data you give us is set out in our Privacy Policy.
We use your personal information to supply products, process payments and, where agreed, inform you about similar products. We only give personal information to third parties where the law requires or allows us to do so.
16. Communications Between Us
This clause only applies if you are a business.
Any notice or communication under the contract shall be in writing and delivered personally, sent by pre-paid first class post, next working day delivery service or email.
17. Returns
If you are not completely satisfied with your purchase, you can return items for a refund. This is subject to return and receipt of goods in original condition and packaging within 30 days of order date.
Please complete the returns form and send it back with the goods. Please do not tape or seal original product boxes directly, as the item may need to be supplied to another customer in resaleable condition.
Please note: We do not offer an exchange service. If you need a different size, colour or item, please place a new order and return the original item for a refund.
Returned items remain your responsibility until we receive them back. For your own protection, we recommend using a delivery service with insurance or tracking if the parcel is over £100.
18. International Orders, Duties and Returns
All products are sold on a delivery duty-unpaid basis, so recipients outside the UK may have to pay import duties or other taxes. Local delivery partners may also charge fees for processing import duties.
Taxes and duties vary from country to country, so we advise checking local costs before ordering.
We are unable to refund import duties or other taxes if a return is required.
For orders shipped outside of the United Kingdom, Gustharts does not provide return shipping labels. Customers are responsible for all international return shipping costs.
19. Other Important Terms
We may transfer our rights and obligations under these terms to another organisation. We will contact you if we plan to do this.
You need our consent to transfer your rights or obligations under these terms, except that you can always transfer any guarantee given by us.
This contract is between you and us. No other person shall have any rights to enforce its terms.
If any court or authority decides that any part of these terms is unlawful, the remaining parts will remain in full force and effect.
These terms are governed by English law. Consumers may bring proceedings in the English courts, or in Scotland or Northern Ireland where applicable. Business disputes are governed by the law of England and Wales and subject to the courts of England and Wales.
